Using a mobile phone whilst driving

What the law says:

From 27th Febuary 2007 you will be breaking the law if you use a hand-held mobile phone whilst driving.
The legislation will make it illegal to use your phone if you hold the phone at any point during its use. The law also applies to any interactive device such as PDAs or navigation aids. "Holding" includes cradling the phone between your ear and shoulder.


What if I don't "hold" the phone and use a ear-piece?

A handsfree kit (with a wired earpiece) will be legal if you don't touch the phone to dial a number or take a call. If your phone has voice recognition or is Bluetooth capable you should use those features. But trailing wires from some kits mean that they still aren't the safest option.

Pressing buttons on your phone will be legal if the phone is held in a secured cradle fixed to the dashboard.



So if I use a wire-free solution I'm perfectly legal?

Yes and no. When driving you must always be in complete control of your vehicle. If you do anything to compromise that safety you can be prosecuted for driving dangerously, or without due care and attention. So if you have to make or take a phone call you are still obliged to do so in a safe way. Using a wire-free headset or hands-free kit doesn't mean you can drive like an idiot!!



What are the penalties for using a mobile phone whilst driving?

To start with there is a fixed penalty of £60 AND 3 points on your license.
If you contest the matter and go to court (and lose, of course) then you can pay up to £1000. However for drivers of goods vehicles this court fine rises to £2500.

If you get caught enough times, you can lose your licence.
